Welcome to Maine Home Photography (“Company,” “we,” “us,” or “our”). By accessing our website, booking our services, or purchasing our products, you agree to be bound by the following Terms & Conditions. Please read them carefully before using our services.

1. Services

We provide professional real estate photography services, which may include:

• Interior and exterior property photography
• Drone/aerial photography (if applicable)
• Virtual tours or video services (if applicable)
• Image editing and post-production
• Digital delivery of media assets
• Floor Plans

All services are subject to availability and confirmation.

2. Booking and Appointments

Appointments may be scheduled through our online booking system or by direct communication.

By booking a session, you agree to:

• Provide accurate property and contact information
• Ensure property access at the scheduled time
• Secure necessary permissions from property owners or occupants
• Prepare the property for photography (cleaning, staging, etc.)

We reserve the right to reschedule or cancel appointments due to weather, safety concerns, or unforeseen circumstances.

3. Pricing and Payment

All pricing is subject to change without notice.

Payments may be processed through third-party providers such as Stripe and/or Square. By submitting payment information, you agree to the terms and privacy policies of those providers.

Unless otherwise agreed:

• Payment is due at the time of booking or delivery
• Services may be withheld until payment is completed
• Late or failed payments may result in suspension of services or additional fees

We do not store full credit card information on our servers.

4. Cancellations and Rescheduling

Cancellations or rescheduling requests must be made at least 8 hours before the scheduled appointment.

• Cancellations made within the required notice period may receive a full or partial refund (at our discretion or based on policy)
• Late cancellations or no-shows may be subject to a cancellation fee up to the full service amount
• Weather-related rescheduling will not incur additional fees

5. Turnaround Time

Typical delivery time for edited images is 24–48 hours, unless otherwise stated.

Delays may occur due to workload, weather conditions, or unforeseen technical issues.

6. Image Delivery

Final images are delivered digitally via download link, online gallery, or booking platform. Download links expire after 30 days. We store the final files for a maximum of 365 days. Expired links can be re-activated during this 365 day period for an additional fee.

We are not responsible for:

• Internet connectivity issues affecting downloads
• Loss of files after delivery
• Improper use or storage of delivered files

7. AI-Assisted Editing and Processing

We may use artificial intelligence (AI) and automated tools as part of our post-production workflow. This can include, but is not limited to:

• Image enhancement and noise reduction
• Color correction and exposure balancing
• Sky replacement or sky enhancement
• Object removal or cleanup
• Sharpening and upscaling
• Virtual staging or digital enhancements (if applicable)

All AI-assisted edits are reviewed and adjusted by a human editor to ensure quality and consistency with our professional standards.

Client Acknowledgment

By booking our services, you acknowledge and agree that:

• AI tools may be used in the creation and editing of delivered images
• AI-enhanced images are considered final professional deliverables
• Minor visual variations may occur due to automated processing techniques
• The use of AI does not transfer ownership of images or alter licensing terms

Limitations of AI Editing

While we strive for accuracy and high-quality results, AI-assisted editing may have limitations, including:

• Imperfect object removal or reconstruction
• Slight inconsistencies in textures or reflections
• Variations in lighting or color rendering across images

We are not liable for outcomes resulting from standard AI processing limitations when used in accordance with industry practices.

No Misrepresentation

We do not use AI to materially misrepresent a property in a deceptive manner. All edits are intended to enhance presentation quality while maintaining a realistic representation of the subject property.

8. Copyright and Licensing

All photographs and media created by Maine Home Photography, it’s affiliates, or it’s independent Capture Agents remain the intellectual property of the Company unless otherwise agreed in writing.

Clients are granted a temporary, non-exclusive, non-transferable license to use delivered images for:

• The duration of your “Listing Agreement” period or one (1) year, whichever is less
• Marketing this specific property
• MLS listings
• Social media promotion
• Print and digital advertising related to the property

Unless otherwise stated, images may not be:

• Resold or redistributed
• Transferred to third parties outside of the listing purpose
• Used for commercial purposes unrelated to the original property

We retain the right to use images for portfolio, marketing, and promotional purposes unless otherwise agreed.

9. Client Responsibilities

Clients agree to:

• Ensure safe access to the property
• Obtain permission from property owners/tenants
• Secure pets, valuables, and personal items
• Prepare the property prior to the shoot

We are not responsible for delays caused by unprepared properties.

10. Weather and Safety

Outdoor shoots and drone photography are weather-dependent.

We reserve the right to reschedule sessions due to unsafe or unsuitable conditions, including:

• Rain, snow, or extreme weather
• Poor visibility or lighting conditions
• Safety risks to equipment or people

11. Use of Third-Party Services

We use third-party services to operate our business, including but not limited to:

• Google Analytics
• Online booking software
• Stripe and/or Square payment processing
• Email and cloud storage providers

We are not responsible for the performance or policies of these third-party services.

12. Limitation of Liability

To the maximum extent permitted by law, Maine Home Photography shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

Our total liability for any claim shall not exceed the amount paid for the services in question.

13. No Guarantee of Results

We do not guarantee specific business outcomes, sales results, or marketing performance from the use of our photography services.

14. Website Use

You agree not to:

• Use the website for unlawful purposes
• Attempt to disrupt or damage the website
• Copy or misuse website content without permission

We may suspend access to the website if misuse is detected.

15. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect and use personal data.

16. Changes to Terms

We may update these Terms & Conditions at any time. Updates will be posted on this page with a revised Effective Date.

17. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Maine, United States, without regard to conflict of law principles.
